PARTICIPATION constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The "Prescott POPS Symphony European Symphonic Tour Raffle" (Raffle) will begin at 3:00:01 PM Mountain Time (Arizona) on August 3, 2008 ("Raffle Start Date"), and ends at 11:59:59 PM MT (Arizona) on December 7, 2008 ("Raffle Period"). Entries must be received and recorded by that date. The Raffle is sponsored by Prescott POPS Symphony, P. O. Box 10232, Prescott, AZ 86304 ("Sponsor").
ELIGIBILITY: This promotion is open to United States citizens and all legal residents of the state of Arizona that are at least 18 years of age as of August 2, 2008. Employees, officers and directors of the Sponsor, its affiliates, subsidiaries, agents, member magazines, advertising and promotion agencies, (collectively including Sponsor, "Raffle Entities") their immediate family members (parents, children, siblings, spouses) and persons living in the same household (whether related or not), are not eligible to participate in the Raffle. All federal, state and local laws and regulations apply. By participating in the "Prescott POPS Symphony European Symphonic Tour Raffle ("Promotion"), participants agree to abide by these official rules and regulations and the decisions of the Sponsor which shall be final and binding as to all matters concerning this Promotion.
HOW TO ENTER: A qualified person may enter by either: 1) Visiting www.prescottsymphony.com and purchasing however many raffle entries desired at $80 per entry. All entries must be purchased/received by 11:59:59 PM MT (Arizona) on December 7, 2008; or 2) completing an Official Prescott POPS Symphony preprinted entry form and submitting the completed entry form along with total raffle purchase amount to The Prescott POPS Symphony, P. O. Box 10232, Prescott, AZ 86304. Entries submitted via postal service must received no later than 11:59:59 PM MT (Arizona) on December 7, 2008. NOTE: An official Prescott POPS Symphony entry form may be obtained at concerts or other venues and places in the state of Arizona, or can be printed in Adobe Acrobat format from a link provided on this website.
PRIZE: There will be one (1) Prize awarded which is a European Symphonic Tour from Aria Tours of Ottowa, Ontario, Canada, for two people. Prize will be awarded with no warranty or guarantee, either express or implied, by Sponsor. Winner is solely responsible for any and all applicable federal, state and local taxes and other costs and expenses associated with prize, required documents and passports to countries of travel, personal expenses, and any other costs not specified herein as being provided. Prize will only be awarded to the verified winner. Specific details of the prize are subject to change based on actual conditions at the scheduled time of trip.
DRAWING AND NOTIFICATION: The Winner will be selected, from among all eligible entries received, in a random drawing conducted at the Prescott POPS Symphony concert on December 14, 2008; Winner need not be present to win. Odds of winning will depend on the total number of eligible entries received, but shall be no more than 1:2500. Winner will be notified by phone and/or mail.
RIGHT TO CANCELLATION: Because the Raffle is a fundraising event, The Prescott POPS Symphony reserves the right to cancel the Raffle should a set number of entry sales fail to be sold (the number of which will cover the cost of the prize). In the event of Raffle cancellation, refunds will be issued to entrants in the amount of $65 ($80 less $15 value of the POPS concert ticket).
PRIZE CONDITIONS: The Winner is solely responsible for all applicable federal, state, and local taxes associated with the receipt of the prize. The Winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release which must be returned within 30 days of written notification, or the prize may be forfeited and an alternate winner selected. If the prize notification is returned as unclaimed or undeliverable to the potential winner, if potential winner cannot be reached within three (7) calendar days from the first notification attempt, or if potential winner fails to return requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such potential winner shall be disqualified and an alternate winner may be selected. The winner's entry, and acceptance of the prize, offered constitutes permission (except where prohibited) for the Prescott POPS Symphony to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
TERMS & CONDITIONS: This Raffle is subject to all applicable federal, state, and local laws. By entering the Raffle, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and Raffle Entities from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Raffle or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that the Sponsor and Raffle Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Raffle mechanics and/or implementation will be prosecuted to the fullest extent of the law. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules.
